Terms of Service
These Terms of Service (the “Terms”) govern the use of the service known as “Ohenro Gift Service” (the “Service”) provided by Ohenro Gift Service (“we,” “us,” or “our”). By applying for or using the Service, you agree to be bound by these Terms.
Article 1 (Application of These Terms)
- These Terms apply to all matters relating to the Service between us and the user.
- Any pricing tables, notices, guides, Q&A pages, or other rules and information presented on our website or otherwise made available by us (the “Supplemental Rules”) form part of these Terms.
- If there is any conflict between these Terms and the Supplemental Rules, the Supplemental Rules will prevail.
Article 2 (Definitions)
- “User” means a person who applies for the Service and whose contract with us has been concluded.
- “Person Concerned” means the person for whom the pilgrimage is intended, including the user, a family member, or a deceased loved one.
- “Deliverables” means the items provided through the Service, including but not limited to the nokyocho stamp book, PDF pilgrimage report, photographs, videos, streaming URLs, and archived recordings.
- “Service Commencement” means the point at which we begin traveling to the site for the purpose of carrying out the Service, or the point at which we begin providing any part of the Service, including filming or report preparation.
- “Partial Performance” means any situation in which, after Service Commencement, any part of the Service has been performed, including temple visits, streaming, filming, editing, report preparation, or creation of a shared page.
Article 3 (Description of the Service)
- Based on the user’s application details, the Service consists of carrying out part or all of the Shikoku 88-Temple pilgrimage, sharing the process, and providing Deliverables.
- The Service does not guarantee any religious effect, spiritual blessing, wish fulfillment, or similar result.
- The itinerary, order of temple visits, streaming times, arrival times, total number of days, and other details may change due to weather, natural disasters, temple circumstances, road conditions, congestion, safety considerations, or our physical condition. The user acknowledges and accepts this in advance.
Article 4 (Application and Formation of Contract)
- A contract for the Service is formed when the user applies through the method designated by us, we accept the application, and we confirm receipt of payment.
- We may decline an application if the requested content is inappropriate or if we determine that providing the Service would be difficult.
Article 5 (Fees, Payment, and Charges)
- Fees are based on the quotation, pricing table, or application page presented by us.
- Payment must be made by a method designated by us, such as bank transfer or credit card payment.
- Any bank transfer fees, credit card installment fees, or other charges imposed by financial institutions or card issuers shall be borne entirely by the user.
- If we make purchases on the user’s behalf for services such as “Real-Time Conversation & Shopping” (primarily under the Premium Plan), we may ask the user to make an advance deposit for the expected purchase amount. After the purchase is completed, the actual amount will be settled.
- If costs arise for religious items, souvenirs, shipping, packing, or related handling, the user shall bear those costs in accordance with our instructions.
Article 6 (Provision of Address and Other Information)
- In order to ship the nokyocho stamp book, reports, commemorative items, souvenirs, or other Deliverables, we may request that the user provide a delivery address, full name, telephone number, and similar information.
- If the user does not provide the necessary information, we may be unable to ship the Deliverables. In such cases, no refund will be made unless the issue is attributable to us.
Article 7 (Schedule, Suspension, and Resumption)
- The pilgrimage schedule will, in principle, be decided through consultation between us and the user.
- For reasons of health and safety, we expect to take one rest day per week (the specific day may vary). Rest days will generally be announced in advance.
- However, due to physical condition, accident, trouble, weather, or other circumstances on the day, we may cancel or change the day’s operation without prior notice.
- If the operator becomes unable to continue due to illness or other reasons, the Service will resume once recovery has been achieved. The period until resumption will depend on the recovery situation.
- Any stated number of days or service period is only an estimate and may change depending on weather, progress, physical condition, or other circumstances.
Article 8 (Streaming, Connectivity, and Equipment Issues)
- Live streaming may experience video or audio disruption, delay, interruption, or stoppage due to internet connectivity, signal conditions, platform problems, equipment malfunction, battery issues, or similar causes. The user acknowledges and accepts this in advance.
- Even if a live stream is interrupted, we will generally record the footage using backup equipment where possible and share it later as an archived recording to the extent feasible.
- However, the user acknowledges that some recorded data may still be incomplete or partially missing.
Article 9 (Filming Restrictions and Suspension of Filming)
- If filming is prohibited or restricted within temple grounds, the Main Hall, the nokyo office, or other locations, we will temporarily suspend filming or limit the scope of filming.
- Even if filming is suspended or restricted, the pilgrimage visit itself will still be carried out properly, and alternative records will be created where possible, such as records made outside the restricted area or written records.
Article 10 (Viewing Period for Photos, Videos, and Deliverables)
- We generally guarantee online access to photos, videos, shared pages, and archives for one year.
- However, if third-party platforms such as YouTube are used on a free basis, continued access may become unavailable due to platform specification changes, policy changes, service suspension, account restrictions, or similar issues.
- Even in such cases, we will consider reasonable alternatives where possible, such as providing another link or re-uploading the material, but we do not guarantee permanent storage or permanent access.
Article 11 (Pilgrimage with Cherished Keepsakes: Handling of Entrusted Items and Disclaimer)
- For the “Pilgrimage with Cherished Keepsakes” service, we may receive and carry photographs or personal items entrusted to us by the user during the pilgrimage.
- We will handle entrusted items with care and make our best efforts to prevent loss, damage, or deterioration.
- However, even if loss, damage, or staining occurs due to accident, weather, force majeure, or similar causes during the pilgrimage,we will not provide compensation of any kind.
- The user shall avoid sending irreplaceable one-of-a-kind items, valuable items, or items that would be difficult to restore if damaged, and should, where possible, send copies or items that can be replaced.
Article 12 (Cancellation and Refunds)
- The user may request cancellation before Service Commencement and before any part of the Service has been performed (that is, before the circumstances described in Article 2 as “Service Commencement” or “Partial Performance” have occurred).
- If the user cancels for personal reasons after payment has been made but before Service Commencement, we will refund the amount paid minus an administrative fee of $50 USD (tax excluded). Any transfer fee for the refund will be borne by the user.
- No refund will be made once Service Commencement has occurred (including the beginning of our travel to the site), or once any part of the Service such as filming or report preparation has been provided, because costs for preparation, travel, and implementation have already been incurred.
- If we are unable to complete the Service for reasons on our side, and we determine that providing the Service on an alternative date is also difficult, we will refund the full service fee received.
- If the Service is postponed due to weather, safety considerations, illness, or similar reasons, no refund will generally be made, and the Service will instead be carried out on a rescheduled date (except where Paragraph 4 applies).
Article 13 (Prohibited Conduct)
The user must not engage in any of the following acts:
- Redistributing, reposting, selling, or publicly sharing Deliverables such as photographs, videos, or streaming archives to third parties without our permission
- Defaming, threatening, harassing, or damaging the reputation of us or any third party
- Any act that violates laws or public order and morals
- Any other act that we reasonably determine to be inappropriate
Article 14 (Copyright and Permitted Use)
- As a general rule, all copyrights and related rights in Deliverables created, filmed, or prepared by us through the Service belong to us.
- The user may view and store the Deliverables only for personal use (including sharing within the family).
- If the user wishes to publish any Deliverable on social media, websites, or elsewhere, prior permission must be obtained from us.
Article 15 (Disclaimer of Liability)
- We will respond within a reasonable scope if part of the Service cannot be carried out as planned due to communication failure, streaming platform issues, temple circumstances, weather, natural disasters, accidents, physical condition, or similar reasons. However, we do not guarantee complete or uninterrupted performance in all cases.
- Except in cases of intentional misconduct or gross negligence on our part, we shall not be liable for any damage suffered by the user in connection with the Service.
Article 16 (Handling of Personal Information)
We will handle personal information obtained from users appropriately in accordance with our Privacy Policy.
Article 17 (Changes to These Terms)
We may revise these Terms when necessary. Any revised Terms will take effect once they are announced by the method designated by us.
Article 18 (Governing Law and Jurisdiction)
These Terms shall be governed by the laws of Japan. Any dispute arising in connection with the Service shall be submitted to the exclusive jurisdiction of the district court having jurisdiction over our location as the court of first instance.
